Winning Ugly

I kept my word with myself today. I slept through the entire day. Never once did I rise to do anything. So I woke up around 5pm. I took a shower, got dressed and went to work.

While on my way out of my apartment building I decided to check my mailbox. Volia, The Arbitration Decision had arrived.

Being as I had to get to work and I need to drive through a fast food drive thru to eat. I took the letter with me to read in the Drive Thru Line Up.

I arrived at the Drive Thru. I thought I might be making a timing mistake because their was a couple of people in front of me when I got there. But oh well, fuck it! I needed food. It gave me a chance to read the letter.

The letter stated out explaining the facts as understood by the arbitrator. This decision wasn't making me look good. I tell ya. I knew I lost. The Decision was three pages in total and I read through it following the arbitrator's logic/thinking process.

Anyway, After slashing and hacking my side to pieces she saved the very best for last.

She continued on with her logic but she switched over to talking about the landlord. She explained she was persuaded to believe that there was a problem on the day in question and that I had been slow in rectifying the problem. All this was at the end of page two. So, I got ready for the final death blow and turned over the page to the final page of the decision.

That's when I noticed something really, really strange. She was starting a new paragraph. Now that in itself is not strange. It's strange in the fact she started the paragraph with one extremely exciting word for me. That word ladies and gentlemen was "However"

Yep, However she was siding with me. She said this was because the landlord stated their legal rights were impaired but never stated how or why. They claimed "Extraordinary Damage" yet failed to prove how. Explaining further the burden of proof was on the shoulders of the landlord.

She didn't let me off scot-free. She did give me a caution that I needed to be diligent with keeping up the sanity of the unit and that if the landlord felt I wasn't he could file another notice to end the tenancy.

So, I win.

But I lose because I'll be moving anyway. No one can expect the relationship between myself and the real estate agent to improve from this point. I think they'll be pissed with this decision.

I think I'll probably see another Eviction Notice at the end of this month. I think I'll be trumping them with my own notice to end the tenancy. It's just better at this point to move on but dammit I was gonna do it on MY terms and I've managed that.

I really didn't expect to win. I'll take it though. A Win is a Win. Even if you win ugly.
